This Privacy Notice has been prepared by Winners, HomeSense and Marshalls which are owned and operated by Winners Merchants International L.P. (“WMI”), a subsidiary of The TJX Companies, Inc. (“TJX”) doing business in Canada as TJX Canada (“TJX Canada”). This Privacy Notice sets out the manner in which TJX Canada collects, uses, discloses and otherwise manages the personal information of its customers.
This Privacy Notice applies to the privacy practices at our Winners, HomeSense and Marshalls (“Stores”), on our websites located at www.winners.ca, www.homesense.ca and www.marshallscanada.ca (“Websites”), and other interactions with our customers.
Collection and Use of Personal Information The term “personal information” means information about an identifiable individual, including name, address, email address, signature, and other information relating to an individual.
We may collect personal information when you:
• Purchase or return merchandise at one of our Stores;
• Purchase one of our gift cards on-line;
• Consent to receive promotional email, SMS text messages, job postings and other communications;
• Visit or register on our Websites;
• Participate in our contests, sweepstakes or promotions;
• Participate in one of our surveys or other customer research;
• Apply for employment;
• Contact or visit our Customer Service Department, or otherwise contact us or one of our service providers with a comment, question or complaint; and
• Enroll in a loyalty or other reward program;
Shopping at HomeSense: You do not have to provide us with any personal information when you purchase merchandise with cash at one of our Stores. If you use a credit or debit card for your purchase, we collect your debit or credit card-related information and your signature to process and administer your payment.
When you purchase one of our gift cards on-line, your name, billing address, the address for delivery, phone number, email address, credit card information, amount of the purchase, and a username and password are collected. This information is used to process and fulfill your gift card order.
We offer customers the opportunity to place items in our Stores on hold until end of same day. To place merchandise on hold, we ask for the customer’s name for this purpose.
From time to time we may supplement the personal information of our customers with information from publicly available sources, such as information to validate the accuracy of your address or other information you have provided us. This helps us maintain the accuracy of your personal information, understand and improve the nature of our product and service offerings, and/or to assist in the selection of Store locations.
Merchandise Returns: For all merchandise returns, we collect customers’ signatures to acknowledge their receipt of the refund and for the administration of our loss prevention program. For merchandise returns where a customer receives a refund on a debit or credit card, we will collect and use debit and credit-related information to process and administer the refund transaction.
When you return merchandise at one of our Stores without a receipt, we collect certain personal information to process and track returns and to help administer our loss prevention program. To return merchandise without a receipt, we collect your name and address and require customers to provide valid government-issued photo identification. Your government issued identification number is not retained, but is electronically converted into a substitute number. The substitute number, the identification type, and your name and address are stored on our systems in Canada and the United States to help administer our loss prevention program.

Email, SMS Text Messaging, and other Communications: From time to time, we may collect certain personal information (such as first and last name and email address) to send you email, SMS text messages and other communications about products, jobs, services, promotions or events that may be of interest to you about Winners, Marshalls, HomeSense, TJX Style + Loyalty Program or other brands that TJX Canada may offer in Canada. We may also collect optional information such as your postal code, gender and favourite departments. We use this information to tailor our communications to you.
You can opt-out of receiving promotional email from us by doing one of the following:
• If you originally signed up for email on our Websites, please return to the ”Subscribe Now” page on the Websites, and click on the “unsubscribe” link, then enter your email address and click the “Submit” button. Please be sure to use the same email address as that which you used to sign-up, otherwise it may not be possible to comply with your request. To opt-out of our careers newsletters, go the careers link on our websites and click on “click here to unsubscribe”.
• If you have received an email, you can follow the opt-out or “unsubscribe” instructions provided in your email.
• Contacting our Customer Service Department by clicking on our “Contact Us” page on our Websites or by calling 1-800-646 9466 (English) or 1-888-405-2335 (French). Hours of operation: Monday to Friday between 9:00 a.m. – 5:00 p.m. (Eastern Time).
If you have signed up to receive SMS text messages, you may opt out by following the opt-out instructions provided in your SMS messages.
Online Registration: You do not have to register to visit our Websites. Some of the features offered through our Websites may require you to register and provide your name, address, phone number, email address, and a password that you select. Your registration information is used to provide and otherwise administer the service you requested. We may also request certain optional additional information, or offer you the opportunity to participate in one of our customer surveys or research. If you choose to participate, we use the optional information and survey results to help us understand our customers and to tailor and enhance our product and service offerings, promotions and events. When you register we may also provide you with an opportunity to sign-up for future promotional email, SMS text messages or other communications. If you wish to withdraw your consent for such communications, please refer to the instructions above.
Fab Finds: Certain Websites may offer our Fab Finds program. When you register for our Fab Finds program, we may collect your name, email address, and other information you provide. We use this information to administer the Fab Finds program. Information you share, including your name and comments you submit, may be displayed on our Websites and also made available to people using the Fab Finds application.
TJX Canada STYLE+TM Loyalty Program Program: When you register for the TJX Canada STYLE+TM Loyalty Program, we may collect information such as your name, email address, postal address, date of birth and phone number. When you use your TJX Canada STYLE+TM Loyalty Program card, we may collect information regarding your purchases and other uses of the card. We may use this information to communicate with you about the benefits of the TJX Canada STYLE+TM Loyalty Program, track your accumulation of loyalty points or other benefits; identify your product and service preferences so that we can notify you of new or additional products, services, features, promotions or events and special offerings relating to Winners, HomeSense Marshalls and other brands that TJX Canada may offer in Canada that might be of interest to you; and for other purposes as described in the TJX Canada STYLE+TM Loyalty Program Privacy Notice.
Contests, Sweepstakes and Promotions: When you enter a contest, sweepstakes or participate in a promotion, we may collect your name, address, phone number, email address, and other information you provide. We use this information to administer your participation in the contest, sweepstakes or promotion. At the time you enter the contest, sweepstakes or promotion, we may obtain your consent to send you future promotional communications. If a contest, sweepstakes or promotion is jointly sponsored by us and one or more sponsors, your personal information may be shared with such sponsors, as specified at the time of collection of your personal information. We do not control the use, disclosure or security of your personal information by other sponsors, and recommend you review their respective privacy notices or statements.
The “Invite a Friend” and other similar features on our Websites permit you to send email to others. This feature requires you to submit your name and email address, as well as the name and email address of the recipient. We do not use the names or email addresses submitted in these circumstances for any other purpose without the consent of you or the email recipient to do so. Please ensure that you only submit email addresses of individuals with whom you have a personal or family relationship.
Surveys and Customer Research: From time to time, we may offer you the opportunity to participate in one of our surveys or other customer research. The information obtained through our surveys and customer research is used in an aggregated, non-personally identifiable form. We use this information to help us understand our customers, to enhance our product and service offerings, promotions and events, and/or to assist in the selection of store locations.
Employment at HomeSense: In connection with a job application or related inquiry, you may provide us with certain personal information about yourself (such as that contained in a resume, cover letter, or similar employment-related materials). We use this information for the purpose of processing and responding to your application for current and future career opportunities.
Customer Service: When you contact our Customer Service Department, communicate with a member of management or Associate in a Store or otherwise contact us or one of our service providers with a comment, question or complaint, you may be asked for information that identifies you (such as your name, address and a phone number) along with additional information we need to help us promptly answer your question or respond to your comment or complaint. We may also retain this information to assist you in the future and to improve our customer service, product and service offerings, and events and promotions.
Children’s Privacy: We do not seek nor will we knowingly collect personal information from anyone under the age of 13.
We may offer you the opportunity to engage with our content on or through third-party social networking websites, plug-ins and applications. When you engage with our content on or through third-party social networking websites, plug-ins and applications, you may allow us to have access to certain information associated with your social media account (e.g., name, username, email address, profile picture, gender) to deliver the content or as part of the operation of the website, plug-in or application. When you provide information from your social media account, we may use this information to personalize your experience on the Websites and on the third-party social networking websites, plug-ins and applications, and to provide you with other products or services you may request.
Disclosure of Personal Information
We will not disclose, trade, rent, sell or otherwise transfer your personal information, without your consent, except as otherwise set out herein.
Service Provider Arrangements: We may transfer (or otherwise make available) your personal information to our affiliates and other third parties who provide services on our behalf. For example, we may use service providers to authorize and process payments, host our Websites, operate certain of its features, serve advertisements, send email, SMS text messages or other communications, run our contests and promotions, conduct customer research, manage and analyze data and our advertising effectiveness, and fulfill gift card orders.
Your personal information may be maintained and processed by our affiliates and other third party service providers in the US or other jurisdictions. Our service providers are given the information they need to perform their designated functions, and we do not authorize them to use or disclose personal information for their own marketing or other purposes.
Sale of Business: We may transfer any information we have about you as an asset in connection with a merger or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of WMI, TJX Canada and/or TJX or as part of a corporate reorganization or stock sale or other change in corporate control.
Legal, Compliance and Loss Prevention: WMI, TJX Canada, our TJX affiliates and our Canadian, US and other service providers may provide your personal information in response to a search warrant or other legally valid inquiry or order, or to an investigative body in the case of a breach of an agreement or contravention of law, or as otherwise required or permitted by applicable Canadian, US or other law. We may also disclose personal information where necessary for the establishment, exercise or defence of legal claims and to investigate or prevent actual or suspect loss or harm to persons or property.
Cookies, Internet Advertising, and Additional Information about our Websites
Visiting our Websites: In general, you can visit our Websites without telling us who you are or submitting any personal information. However, we collect the IP (Internet protocol) addresses of all visitors to our Websites and other related information such as page requests, browser type, operating system and average time spent on our Websites. We use this information to help us understand our Website activity, and to monitor and improve our Websites.
Tracer Tags & Web Beacons: Our Websites may also use a technology called "tracer tags" or “Web Beacons”. This technology allows us to understand which pages you visit on our Websites. These tracer tags are used to help us optimize and tailor our Websites for you and other future visitors to our Websites.
Security of Personal Information
We have implemented measures designed to protect personal information in our custody and control, including appropriate measures to protect the safety of credit and debit card and other transactions in our Stores. We maintain reasonable administrative, technical and physical safeguards in an effort to protect against unauthorized access, use, modification and disclosure of personal information in our custody and control. Unfortunately, no collection or transmission of information over the Internet or other publicly accessible communications networks can be guaranteed to be 100% secure, and therefore, we cannot ensure or warrant the security of any such information.
Your online access to certain of your personal information may be protected with a password you select. We strongly recommend that you do not disclose your password to anyone. We will never ask you for your password in any unsolicited communication (such as letters, phone calls or email messages).
We have personal information retention processes designed to retain personal information of our customers for no longer than necessary for the purposes stated above or to otherwise meet legal requirements.
Access to your Personal Information
You have the right to access, update, and correct inaccuracies in your personal information in our custody and control, subject to certain exceptions prescribed by law.
You may update your email address by going to the Winners email sign-up page on our Websites and doing the following:
• Click on the "unsubscribe" link to delete your old email address, and
• Return to the email sign-up page and sign-up using your new address.
You may access and update your resume information submitted via one of our Websites on the "Careers" page, by doing the following:
• Go to the "Our Careers" page, click on "Returning User" and enter your login name and the password that you set up at the time of registration.
You may request access, updating and corrections of inaccuracies in other personal information we have in our custody or control by emailing or writing to us at the contact information set out below. We may request certain personal information for the purposes of verifying the identity of the individual seeking access to their personal information records.
Changes to the Privacy Notice
This Privacy Notice may be updated periodically to reflect changes to our personal information practices. The revised Privacy Notice will be posted on the Websites, and is available by requesting it from Store Management at our Stores. We strongly encourage you to please refer to this Privacy Statement often for the latest information about our personal information practices.
